Godkännande av handelsvillkoren
1. Dessa handelsvillkor gäller för dig, en privatperson som inte agerar som en kommersiell enhet, för köp av produkter på webbplatsen www.youthandearth.com. Du och Youth & Earth är överens om att dessa Handelsvillkor tillsammans med beställningen, som accepterats av Youth & Earth, Användarvillkoren och Integritetspolicyn, utgör hela avtalet mellan dig och Youth & Earth.

Ändring av handelsvillkoren

Definitioner och tillämpning

I dessa handelsvillkor betyder "Youth & Earth" Empower3d Limited, som handlar under namnet Youth & Earth, "du" och "din" betyder dig, den person som beställer produkterna, "produkterna" betyder de Youth & Earth-produkter som kan beställas på webbplatsen www.youthandearth.com och "produktsubtotal" betyder summan av priset för varje beställd produkt enligt vad som anges på webbplatsen www.youthandearth.com vid tidpunkten för beställningen.

UK Fraktavgift
Royal Mail eller Yodel 4 dagars spårad tjänst - alla beställningar under £ 50 är föremål för en £ 4 fraktavgift. alla beställningar över £ 50 kommer fraktkostnaderna att vågas.

Leverans
1. Youth & Earth kommer att göra rimliga ansträngningar för att leverera en beställning inom 7 arbetsdagar (måndag-fredag exklusive officiella helgdagar) från det datum då beställningen skickades av dig.
2. Du kommer att behöva kvittera alla leveranser.
Beställningar
1. För att lägga en beställning av Produkter måste du:
(a) create an account with Youth & Earth on the www.youthandearth.com website by registering your details and creating a password which will be associated to your username (the email address which you have indicated); and
(b) complete and submit the online order through your Youth & Earth account.
2. Youth & Earth reserves the right to refuse any order. In such case, Youth & Earth will notify you as soon as reasonably practicable, providing you with the reasons for such refusal, and refund to you any payment in full.
3. Once Youth & Earth has accepted your order an order confirmation email will be sent to you at which point these Terms of Trade will become binding on you and Youth & Earth. The status of your order will be shown on your Youth & Earth account.
Prices and Payment
1. All prices on the website are in pound sterling and are inclusive of VAT. Any change in the VAT rate may be applied to the Products. Prices are subject to change without notice. The price applicable to any order is the price indicated on the www.youthandearth.com website at the time of submitting the order.
2. The amount payable to Youth & Earth for an order will be the total of the following amounts:
(a) the Product Subtotal;
(b) the cost of delivery as stated above
3. You must pay the order amount by either Visa, MasterCard, Visa Debit, American Express, or PayPal at the time of submitting the order. Payments will be made through the secure PayPal system, which uses the SSL "Secure Socket Layer" protocol, so that all information is encrypted by software and no third-parties may have access to this information during the processing of your payment for the Products.
Liability
1. Youth & Earth will only be responsible for loss or damage you suffer that is a natural and foreseeable consequence of Youth & Earth breaching its obligations under these Terms of Trade, but Youth & Earth is not responsible for loss or damage that was not foreseeable, such as for damages resulting from the your use of the Internet including the loss of data, any intrusion, virus, service disruption or other unintended issues.
2. Youth & Earth reserves the right, in its absolute discretion, to take any of the following measures if you fail to make a payment in accordance with these Terms of Trade:
(a) withhold the supply of and dispose of the Products requested in the order, and/or
(b) refuse to deal further with you, and Youth & Earth will not be liable to you for any loss or damage directly or indirectly resulting from any such action.
3. You have sole responsibility for determining the suitability of the Products for the purposes for which you intend to use them.
4. The Products are supplied for domestic and private use only. Youth & Earth shall not be liable for any losses relating to any business of yours, for example, lost revenue, income or profits, lost data or any interruption to your business.
5. You must follow any instructions Youth & Earth may give you in relation to the safe use or storage of the Products. Youth & Earth will not be responsible for any damage to the Products which is caused by your failure to follow these instructions.
6. There are certain responsibilities which Youth & Earth cannot exclude by law and nothing in these Terms of Trade limits any liability of Youth & Earth to you for death or personal injury resulting from negligence. Subject to the following "Warranty" clause, and to the fullest extent permitted by law, the liability of Youth & Earth for any loss or damage suffered by you as a result of Youth & Earth breaching its obligations under these Terms of Trade or other duty is limited to a refund or replacement of the relevant Products.
Warranty
1. As a consumer you have certain legal rights, including legal rights relating to any Products that are faulty or not as described. For further information about your legal rights, contact your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms of Trade will affect these legal rights.
2. If you receive a Product that is not of satisfactory quality, you can contact Youth & Earth for a replacement or, where this is not possible, for a refund.
Your right to cancel the purchase
1. As a consumer, you have the right to return the Products, without any reason within 30 working days from the receipt of the Products.
2. If the return of the Products is not because of a product defect or an error committed by Youth & Earth, you will have to pay the shipping charges for the return of the Products.
3. If you exercise this right to return the Products, you will return the Products ordered, in a state fit for their resale and in their original packaging
4. Youth & Earth kommer att återbetala dig inom 30 dagar från det att du utnyttjat din rätt att ångra köpet.
Återbetalningar och returer
1. Endast produkter som köpts på webbplatsen www.youthandearth.com för kunder i Storbritannien och Irland kan returneras till Youth & Earth för återbetalning eller byte. Produkter som köpts i en specialaffär eller någon annanstans måste returneras till den ursprungliga inköpsstället.
2. Om du gör ett fel när du beställer online, kommer Youth & Earth gärna att byta ut din produkt mot den produkt du avsåg att köpa. Den returnerade varan måste vara oöppnad och i sitt ursprungliga säljbara skick. Du är ansvarig för frakt och extra portokostnader.
3. I händelse av att du reagerar på en produkt har du möjlighet att byta ut eller återbetala den.
4. Alla produkter måste returneras till:
Du ansvarar för de fraktkostnader som uppkommer när du skickar tillbaka produkterna till Youth & Earth. Fraktkostnaden på 5 GBP kommer att betalas om den efterföljande återbetalningen minskar det ursprungliga orderbeloppet till under tröskelvärdet för fri frakt på 75 GBP.
5. Om en produkt skadas när den skickas till dig kommer Youth & Earth att ge dig en fullständig återbetalning eller ett byte. Returporto återbetalas för skadade, defekta eller felaktigt skickade produkter och återbetalning sker via den metod som användes vid betalningen.
6. I samtliga fall måste originalinköpsbevis uppvisas och produkterna måste returneras inom 14 dagar efter mottagandet för att Youth & Earth ska kunna behandla återbetalning eller byte. Vänligen ring +447572174740 eller skicka ett e-postmeddelande till [email protected] i förväg om din avsikt att returnera eller byta en produkt, så att Youth & Earths personal kan hjälpa dig med en smidig transaktion.
7. Spara ditt postkvitto tills du är säker på att ditt paket har mottagits på ett säkert sätt av Youth & Earth. Vi kan behöva se detta om vi inte lyckas ta emot ditt paket.
8. Vi kommer att göra vårt bästa för att behandla returer inom 10 arbetsdagar efter mottagandet och en återbetalning kommer att utfärdas via den metod som användes för betalning.
Force Majeure
1. Om Youth & Earth försenas, hindras eller förhindras att fullgöra någon av sina skyldigheter enligt någon order på grund av någon händelse eller omständighet utanför dess rimliga kontroll, har Youth & Earth inget ansvar gentemot dig med avseende på sådan underlåtenhet och tiden för att fullgöra densamma kommer att förlängas tills händelsen eller omständigheten har upphört.
Personuppgifter
1. Information som du tillhandahåller för beställning av Produkterna kommer att behandlas automatiskt av Youth & Earth. Se vår Integritetspolicy för ytterligare information om behandlingen av dina personuppgifter.
Andra viktiga villkor
1. Youth & Earth kan komma att överföra sina rättigheter och skyldigheter enligt dessa Handelsvillkor till en annan organisation.
2. Dessa Handelsvillkor gäller endast mellan dig och Youth & Earth. Ingen annan person ska ha någon rätt att verkställa något av villkoren i dessa Handelsvillkor.
3. Om något villkor i dessa Handelsvillkor befinns vara olagligt, ogiltigt eller ogenomförbart av någon domstol eller behörig myndighet, kommer de återstående villkoren att förbli i full kraft och verkan.
4. Om du bryter mot dessa Handelsvillkor och Youth & Earth inte vidtar någon åtgärd, innebär detta inte att Youth & Earth har avstått från sina rättigheter gentemot dig. Du kommer fortfarande att behöva följa dessa handelsvillkor. Varje avstående måste skriftligen godkännas av Youth & Earth.
Tillämplig lag
1. Om platsen för leverans av Produkterna är i:
(a) England eller Wales, regleras dessa handelsvillkor av engelsk lag och alla tvister eller anspråk som uppstår på grund av eller i samband med deras tolkning eller utförande kommer att omfattas av de engelska domstolarnas icke-exklusiva jurisdiktion; eller
(b) Skottland, regleras dessa handelsvillkor av skotsk lag och alla tvister eller anspråk som uppstår på grund av eller i samband med deras tolkning eller utförande kommer att omfattas av de skotska domstolarnas exklusiva jurisdiktion; eller
(c) Nordirland, dessa handelsvillkor styrs av nordirländsk lag och alla tvister eller anspråk som uppstår på grund av eller i samband med deras tolkning eller genomförande kommer att omfattas av de nordirländska domstolarnas exklusiva jurisdiktion.
2. Informationen i detta dokument gäller för webbplatsen för onlineförsäljning som drivs av Youth & Earth UK Limited.
