Accettazione delle Condizioni commerciali

1. Le presenti Condizioni commerciali si applicano all'utente, persona fisica che non agisce in qualità di entità commerciale, per l'acquisto dei Prodotti sul sito web www.youthandearth.com. L'utente e Youth & Earth che le presenti Condizioni commerciali, insieme all'ordine accettato da Youth & Earth, alle Condizioni d'uso e all'Informativa sulla privacy, costituiscono l'intero accordo tra l'utente e Youth & Earth. 

2. Si prega di leggere attentamente le presenti Condizioni commerciali in quanto contengono informazioni importanti, comprese informazioni sulle garanzie e sulle limitazioni di responsabilità. Effettuando un ordine tramite il sito web www.youthandearth.com, l'utente dichiara di aver letto e accettato le presenti Condizioni commerciali.

Modifica delle Condizioni commerciali 

1. Youth & Earth ha il diritto di modificare le presenti Condizioni commerciali di volta in volta per conformarsi alla legge o per soddisfare le sue mutevoli esigenze commerciali. Eventuali modifiche alle Condizioni commerciali saranno applicate a qualsiasi ordine registrato dopo l'entrata in vigore delle Condizioni commerciali modificate e pubblicate sul sito web www.youthandearth.com.

Definizioni e applicazione

1. Nelle presenti Condizioni commerciali, perYouth & Earth" si intende Empower3d Limited, che opera come Youth & Earth, per "voi" e "vostro" si intende l'individuo che ordina i Prodotti, per "Prodotti" si intendono i prodotti Youth & Earth che possono essere ordinati sul sito web www.youthandearth.com e per "Subtotale dei Prodotti" si intende la somma del prezzo di ciascun Prodotto ordinato, come indicato sul sito web www.youthandearth.com al momento dell'invio dell'ordine.

Area geografica

1. La vendita online dei Prodotti offerti sul sito web www.youthandearth.com è destinata esclusivamente a individui che risiedono nel Regno Unito [continentale] e per la consegna solo all'interno di tale area geografica.

1. I Prodotti oggetto delle presenti Condizioni commerciali sono quelli presentati sul sito web www.youthandearth.com, in base alla disponibilità.

2. Youth & Earth farà del suo meglio per garantire che qualsiasi fotografia dei Prodotti presentata sul sito www.youthandearth.com sia il più accurata possibile. Si prega di notare, tuttavia, che la rappresentazione dei Prodotti come prodotta dallo schermo del vostro computer potrebbe differire dal Prodotto esatto.

UK Shipping Fee

Consegna 

1. Youth & Earth farà il possibile per consegnare un ordine entro 7 giorni lavorativi (dal lunedì al venerdì, escluse le festività ufficiali) dalla data di inoltro dell'ordine.

2. Vi sarà richiesto di firmare per tutte le consegne.

Ordini 

1. Per inviare un ordine di Prodotti è necessario: 

(a) create an account with Youth & Earth on the www.youthandearth.com website by registering your details and creating a password which will be associated to your username (the email address which you have indicated); and 
(b) complete and submit the online order through your Youth & Earth account. 

2. Youth & Earth reserves the right to refuse any order. In such case, Youth & Earth will notify you as soon as reasonably practicable, providing you with the reasons for such refusal, and refund to you any payment in full. 

3. Once Youth & Earth has accepted your order an order confirmation email will be sent to you at which point these Terms of Trade will become binding on you and Youth & Earth. The status of your order will be shown on your Youth & Earth account. 

Prices and Payment 

1. All prices on the website are in pound sterling and are inclusive of VAT. Any change in the VAT rate may be applied to the Products. Prices are subject to change without notice. The price applicable to any order is the price indicated on the www.youthandearth.com website at the time of submitting the order. 

2. The amount payable to Youth & Earth for an order will be the total of the following amounts: 

(a) the Product Subtotal; 
(b) the cost of delivery as stated above 

3. You must pay the order amount by either Visa, MasterCard, Visa Debit, American Express, or PayPal at the time of submitting the order. Payments will be made through the secure PayPal system, which uses the SSL "Secure Socket Layer" protocol, so that all information is encrypted by software and no third-parties may have access to this information during the processing of your payment for the Products. 

Liability 

1. Youth & Earth will only be responsible for loss or damage you suffer that is a natural and foreseeable consequence of Youth & Earth breaching its obligations under these Terms of Trade, but Youth & Earth is not responsible for loss or damage that was not foreseeable, such as for damages resulting from the your use of the Internet including the loss of data, any intrusion, virus, service disruption or other unintended issues. 

2. Youth & Earth reserves the right, in its absolute discretion, to take any of the following measures if you fail to make a payment in accordance with these Terms of Trade: 

(a) withhold the supply of and dispose of the Products requested in the order, and/or 
(b) refuse to deal further with you, and Youth & Earth will not be liable to you for any loss or damage directly or indirectly resulting from any such action. 

3. You have sole responsibility for determining the suitability of the Products for the purposes for which you intend to use them. 

4. The Products are supplied for domestic and private use only. Youth & Earth shall not be liable for any losses relating to any business of yours, for example, lost revenue, income or profits, lost data or any interruption to your business. 

5. You must follow any instructions Youth & Earth may give you in relation to the safe use or storage of the Products. Youth & Earth will not be responsible for any damage to the Products which is caused by your failure to follow these instructions. 

6. There are certain responsibilities which Youth & Earth cannot exclude by law and nothing in these Terms of Trade limits any liability of Youth & Earth to you for death or personal injury resulting from negligence. Subject to the following "Warranty" clause, and to the fullest extent permitted by law, the liability of Youth & Earth for any loss or damage suffered by you as a result of Youth & Earth breaching its obligations under these Terms of Trade or other duty is limited to a refund or replacement of the relevant Products. 

Warranty 

1. As a consumer you have certain legal rights, including legal rights relating to any Products that are faulty or not as described. For further information about your legal rights, contact your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms of Trade will affect these legal rights. 

2. If you receive a Product that is not of satisfactory quality, you can contact Youth & Earth for a replacement or, where this is not possible, for a refund. 

Your right to cancel the purchase 

1. As a consumer, you have the right to return the Products, without any reason within 30 working days from the receipt of the Products. 

2. If the return of the Products is not because of a product defect or an error committed by Youth & Earth, you will have to pay the shipping charges for the return of the Products. 

3. If you exercise this right to return the Products, you will return the Products ordered, in a state fit for their resale and in their original packaging

4. Youth & Earth vi rimborserà entro 30 giorni dall'esercizio del vostro diritto di recesso.

Rimborsi e restituzioni

1. Solo i prodotti acquistati sul sito www.youthandearth.com per i clienti del Regno Unito e dell'Irlanda possono essere restituiti a Youth & Earth per un rimborso o un cambio. I prodotti acquistati presso un rivenditore specializzato o altrove devono essere restituiti al luogo di acquisto originale.

2. In caso di errore durante l'ordine online, Youth & Earth sarà lieta di sostituire il prodotto con il prodotto che intendeva acquistare. L'articolo restituito deve essere integro e nelle condizioni originali di vendita. Le spese di spedizione e le spese postali aggiuntive sono a vostro carico.

3. In caso di reazione a un prodotto, avete la possibilità di cambiarlo o rimborsarlo.

4. Tutti i prodotti devono essere restituiti a: 

Le spese di spedizione sostenute per la restituzione dei Prodotti a Youth & Earth sono a carico dell'utente. Se il rimborso successivo riduce l'importo dell'ordine originale al di sotto della soglia di spedizione gratuita di 75 GBP, sarà addebitato un costo di spedizione di 5 GBP.

5. Se un Prodotto viene danneggiato durante la spedizione, Youth & Earth al rimborso completo o alla sostituzione. Le spese di spedizione per la restituzione saranno rimborsate in caso di prodotti danneggiati, difettosi o inviati in modo errato e il rimborso sarà effettuato tramite lo stesso metodo utilizzato per il pagamento.

6. In tutti i casi, è necessario fornire la prova di acquisto originale e i prodotti devono essere restituiti entro 14 giorni dalla ricezione affinché Youth & Earth elaborare qualsiasi rimborso o sostituzione. Si prega di chiamare il numero +447572174740 o inviare un'e-mail a enquiries@youthandearth.com prima di restituire o sostituire un prodotto, in modo che Youth & Earth possa assistervi per una transazione senza intoppi.

7. Si prega di conservare la ricevuta postale fino a quando non si è certi che il pacco sia stato ricevuto in modo sicuro da Youth & Earth. Potremmo aver bisogno di visionarla nel caso in cui non riuscissimo a ricevere il tuo pacco.

8. Faremo del nostro meglio per elaborare i resi entro 10 giorni lavorativi dal ricevimento e il rimborso verrà effettuato tramite lo stesso metodo utilizzato per il pagamento. 
 

Forza maggiore

1. Se Youth & Earth ritardi, impedimenti o impedimenti nell'adempimento di uno qualsiasi dei suoi obblighi previsti da un ordine a causa di eventi o circostanze al di fuori del suo ragionevole controllo, Youth & Earth non Youth & Earth alcuna responsabilità nei tuoi confronti in relazione a tale inadempimento e il tempo per l'adempimento dello stesso sarà prorogato fino alla cessazione dell'evento o della circostanza.

1. Le informazioni fornite dall'utente per l'ordine dei Prodotti saranno automaticamente elaborate da Youth & Earth. Per ulteriori informazioni sul trattamento dei dati personali, si prega di fare riferimento alla nostra Informativa sulla privacy.

Altri termini importanti

1. Youth & Earth trasferire i propri diritti e obblighi ai sensi delle presenti Condizioni commerciali a un'altra organizzazione. 

2. Le presenti Condizioni commerciali sono stipulate Youth & Earth tra l'utente e Youth & Earth . Nessun altro soggetto avrà il diritto di far valere alcuna delle disposizioni delle presenti Condizioni commerciali.

3. Qualora una qualsiasi disposizione delle presenti Condizioni commerciali fosse ritenuta illegale, non valida o inapplicabile da un tribunale o da un'autorità competente, le restanti disposizioni rimarranno pienamente valide ed efficaci. 

4. Qualora l'utente violi le presenti Condizioni commerciali e Youth & Earth non Youth & Earth alcuna azione, ciò non significa che Youth & Earth rinunciato ai propri diritti nei confronti dell'utente. L'utente sarà comunque tenuto a rispettare le presenti Condizioni commerciali. Qualsiasi rinuncia dovrà essere concordata Youth & Earth iscritto da Youth & Earth .

Legge applicabile

1. Se il luogo di consegna dei Prodotti è: 

(a) Inghilterra o Galles, i presenti Termini commerciali sono regolati dalla legge inglese e qualsiasi controversia o reclamo derivante da o in relazione alla loro interpretazione o esecuzione sarà soggetto alla giurisdizione non esclusiva dei tribunali inglesi; oppure
(b) Scozia, i presenti Termini commerciali sono regolati dalla legge scozzese e qualsiasi controversia o reclamo derivante da o in relazione alla loro interpretazione o esecuzione sarà soggetto alla giurisdizione esclusiva dei tribunali scozzesi; oppure 
(c) Irlanda del Nord, le presenti Condizioni commerciali sono regolate dalla legge dell'Irlanda del Nord e qualsiasi controversia o reclamo derivante da o in relazione alla loro interpretazione o esecuzione sarà soggetto alla giurisdizione esclusiva dei tribunali dell'Irlanda del Nord.
